Courts Covered by the Forsyth County Clerk
The Clerk handles three trial courts under one office. Superior Court, State Court, and Juvenile Court all run through the unified clerk. Probate Court and Magistrate Court keep their own filings outside this office. Knowing which court holds a file decides where to send the records request.
- Superior Court - felony, divorce, equity, title-to-land, declaratory judgment, habeas, mandamus, and certiorari.
- State Court - misdemeanor, traffic, and civil cases not reserved to Superior Court.
- Juvenile Court - juvenile delinquency, dependency, termination, and juvenile traffic; access is restricted by law.
- Probate Court - not under the Clerk; files sit at 100 West Courthouse Square.
- Magistrate Court - not under the Clerk; files sit at 1090 Tribble Gap Road.
How to Request a Forsyth County Certified Copy

- Identify the case number, court, and document by name.
- Choose a route: counter visit, mail, email, or GSCCCA eCertification.
- For mail or email, send the request to ClerkOfCourt@forsythco.com or Suite 1007 with the document details.
- Include payment for the certified copy fee.
- For criminal copy requests, use the criminal copy request form when filing by email.
- Wait for the eCertification email or counter pickup notification.
- Verify the seal and signature before submitting the certified copy to the third party.

Case Search Through the Forsyth County Clerk
The Clerk's Case Search page points users to re:SearchGA for participating Georgia counties. Registration is required. Online document purchasing is also available through the same path. For walk-in searches, the Clerk's counter has public terminals during office hours.
Note: Re:SearchGA is not the same as the county's Odyssey Public Access portal. portal.forsythco.com is a separate Tyler login mainly used by registered counsel and staff.
Forsyth County Clerk Real Estate Records
The Clerk's Real Estate menu is wider than many counties. It includes the Property Index Search, PT-61 e-filing, Real Estate e-filing, Abstractors Assistance, Real Estate Forms, Trade Name Registration, UCC Forms, and Military Discharge Records. The Clerk also offers a property and mortgage fraud check tool that alerts owners when new documents are recorded against a parcel.
Trade-name (DBA) registration runs through the Clerk's office under Georgia law. Filings get indexed and recorded for public access. Military Discharge Records are restricted under Georgia law; access is limited to the veteran or designated representatives.
The Property Index Search is the standard route for deeds, mortgages, liens, releases, and recorded easements. Most title searches in Forsyth County run against this index. Plats are also recorded with the Clerk. A real-estate closing relies on the same index data for title insurance underwriting.
Courthouse Security and Parking
The Clerk maintains a courthouse security and parking page that covers screening, prohibited items, and visitor parking decks.

The security and parking page notes that all entrants are screened by Court Security. Pocket knives, knitting needles, nail clippers, mace, and pepper spray may be confiscated. Outside food and drink are not allowed. Snack machines, water, and juror coffee are available. Public parking is at Mason Street Deck off Main Street and Pilgrim Mill Road behind the County Administration Building, plus the Castleberry Deck and Lot at 101 Castleberry Road. Accessible parking sits between Mason Street Deck and the County Administration Building.
The District Attorney and Indigent Defense
The District Attorney and Indigent Defense work alongside the Clerk inside the same courthouse complex. They are separate offices, but criminal case files all pass through the Clerk's hands.

The Forsyth County District Attorney is Penny A. Penn. Her office prosecutes felony crimes in Superior and Juvenile Courts.

The Indigent Defense office uses private appointed attorneys for financially qualifying criminal and juvenile delinquency cases. Director Melissa Banker leads the program at 678-513-5959.
Self-Help and Legal Aid Resources
The Clerk's office cannot give legal advice. For civil legal aid, statewide help is available through Georgia Legal Services Program.

The Georgia Legal Services Program covers civil legal aid statewide. The Forsyth Clerk's Find a Form link points to forsythcourts.com forms; the Magistrate Court page links the Uniform Magistrate Court Rules, the Georgia Code, and GLSP. The State Bar of Georgia's Find a Lawyer service is the standard referral source for retained counsel.
