How to Find Forsyth County Criminal Records
Forsyth County criminal records sit in several places. The court file lives with the Clerk. The arrest data lives with the Sheriff. The state criminal history sits with the Georgia Bureau of Investigation. Each system handles a different slice of the same record.
Start with the court file. The Clerk of Superior, State & Juvenile Courts runs case search on re:SearchGA. Registration is required. The Clerk's Superior Court criminal division and the State Court criminal & traffic division are the two main holders of case files.
- Search the case by party name on re:SearchGA after creating an account.
- For current jail bookings, use the Sheriff's P2C inmate inquiry.
- For criminal copy requests, email ClerkOfCourt@forsythco.com or use the copy request page.
- For a state criminal history, request a record from the Georgia Bureau of Investigation.
- For federal cases, use PACER and the U.S. Attorney's Northern District.
Forsyth County Superior Court Felony Records
Felony cases run through Superior Court. Chief Judge Jeffrey S. Bagley, Judge David L. Dickinson, and Judge Philip C. Smith share the felony docket. District Attorney Penny A. Penn handles felony prosecution. A felony in Georgia carries a minimum sentence of one year. Common felony files include indictments or accusations, arraignments, motions, pleas, sentence sheets, and final orders.
Drug Court is a Superior Court specialty calendar under Chief Judge Bagley. It is a court-supervised treatment program rather than a normal felony track. Restitution for felony cases is administered through the Department of Community Supervision at 770-781-2170. The original case file remains with the Clerk; the supervision file remains with DCS or the parole authority.
Forsyth County State Court Misdemeanor Records

The State Court Criminal & Traffic Citations Division maintains traffic citations and misdemeanor cases. Wait 10 to 14 business days after a citation before checking a docket. Some cases require mandatory court appearance. Reckless driving, speeding 24 mph or more over the posted limit, and cell phone use violations are not payable online. Forsyth County Arrest and Jail Records

Date of birth, home address, holding facility, properties, release date/time, release reason, and arrest notes are hidden by the agency's public display settings. See inmate records for the full field-by-field walkthrough and released inmates for the bond and release process.
What a Forsyth County Criminal Record Shows
A criminal record in Forsyth County is built from several different documents. The arrest report shows what the officer wrote. The accusation or indictment shows what the prosecutor charged. The disposition shows what the court found or accepted. Reading all three avoids the most common mistake.
| Field | What It Shows |
|---|---|
| Arrest Date | Date the Sheriff or arresting agency booked the person. |
| Booking / Arresting Agency | Sheriff's Office, Cumming Police, GBI, or other agency. |
| Primary Charge | Felony or misdemeanor code listed at booking. |
| Bond Amount / Type | Cash, surety, property, or no-bond status. |
| Case Number | Court-assigned ID once the case is filed. |
| Court / Judge | Superior, State, or Juvenile Court and the assigned judge. |
| Indictment / Accusation | Prosecutor's formal charging document. |
| Plea / Verdict | Guilty, not guilty, nolo, or jury verdict. |
| Disposition | Conviction, acquittal, dismissal, or diversion. |
| Sentence | Prison time, jail time, probation, fine, restitution. |
| Probation / Parole | Supervision agency and report dates. |
Charges vs Convictions in Forsyth County Criminal Records
The single biggest reading mistake people make is treating an arrest as a conviction. The Sheriff's own disclaimer says an arrest does not mean conviction. A charge is a claim. A conviction is a finding.
| Aspect | Charge / Arrest | Conviction |
|---|---|---|
| Source | Police report, accusation, or indictment | Plea, verdict, or court order |
| Who decides | Officer or prosecutor | Judge or jury |
| Legal weight | Allegation only | Established finding of guilt |
| Reversible? | Yes, by dismissal, acquittal, or nolle prosequi | Only through appeal or post-conviction relief |
| Background check | Shows arrest unless restricted | Shows guilt unless sealed by court order |
Note: An arrest can be restricted under O.C.G.A. 35-3-37 when the case ends without a conviction, but a separate process is required.
Georgia Criminal History Record Restriction
Georgia uses "record restriction" rather than the old "expungement" term. The Georgia Bureau of Investigation runs the process. The GBI page on record restrictions explains O.C.G.A. 35-3-37, which lets eligible arrest and charge data be restricted from non-criminal-justice access when approved by the prosecutor.
The GBI page covers the rules and eligibility.

The Georgia.gov page has the consumer-side request walkthrough.

The Georgia.gov restriction process page notes that GCIC usually processes complete applications within two to three weeks. Sending an incomplete packet adds weeks to the wait.
Sealed vs Expunged Forsyth County Records
"Sealed" and "expunged" are not the same thing. Court-file sealing is a court action. State criminal-history restriction is a GBI action. Private background-check cleanup is its own task. Mugshot-site removal is yet another.
| Aspect | Sealed (Court File) | Restricted (State History) |
|---|---|---|
| Who acts | Court that holds the file | GBI and the prosecutor |
| What is hidden | Specific court documents | Arrest entry on GCIC criminal history |
| Still visible to | Parties and court staff | Criminal-justice agencies |
| Process | Motion in the court that sealed the record | GBI/Georgia.gov application |
| Typical timing | Varies by court and motion | About 2-3 weeks after a complete application |
Note: Neither sealing nor restriction destroys a record. Criminal-justice agencies still see them.
